His angle looks like hes parking. I'm sure anyone analyzing your pics will realize this, coupled with the open space for parking to the right. Your position looks like you were following too close to realize his backup lights coming on in time and giving him no time to react, as well. JMO.
Rule of thumb, keep following distance enough for both you and the other driver to react. You'll get over this and move on in time, without a doubt, to bigger, better things and situation. Don't sweat it, just take care of it in fair manner and move on. This is unfortunate and that driver sets a bad example for pickup owners, BSing to the cops like that.

My wife got lightly rear ended last week at a light. She creeped forward then stopped due to a cyclist. The person behind her was on her phone and not even looking in front of her. The passenger tells my wife, "how about I just give your husband $50 and we can forget about this." It ended up being $1200 damage.

accident

The investigation is still pending. it sounds like my insurance is siding with my story. They also said that the other driver isn't cooperating with their questions. I'll call on Monday to check up on the case. On the other hand, my Fit is back. There as a few imperfections with things lining up where they should be, but only noticeable to the Fit Freak eye.

I'm so sorry. That really sucks.

If it helps though, I've had something similar happen to me twice now, and I saw countless similar stories when I worked in claims. You're most likely going to be fine. As other people pointed out, it's pretty easy to tell what happened in an accident if one of the vehicles wasn't moving at the time.
The damage will totally show that you weren't moving.

Best of luck to you, and I'm glad you weren't hurt.

follow up

No final decision. Both insurance companies are still battling over this ordeal. I'm very impatient, because I want justice served against his guy. Every time I pass the road where the accident happened, my blood pressure rises.

Onetime i backed into someone while i was parallel parking, but it was at night and her lights were off, and she tried pulling into the spot forward while i was backing into it and i crushed her Taurus with my Discovery. Several witnesses sided with me, none with her. Its strange no one saw it happen. Clearly you were not moving because there are no skid marks and the plastic looks more slowly bend and pushed down, not smashed and scattered everywhere. What an a--hole sorry man

Woah, man, that's an advertisement for depression right there (the car, not your lovely wife, obviously!)

It seems so completely obvious that the idiot Toyota backed into you! Why can't the cops see that? Maybe after the investigation is over with, they'll see what happened.

I would be if this was my little NHBP! Well, like has been said before, you'll be able to get it all nice and new with your insurance!

Edit: wow, it would help if I read the thread....glad to see that you are back with your wheels! Looks nice!
