dealer screwing me up. Need help

if u signed the paper work then they legally HAVE to sell you an 07 white fit sport with 4 miles on it, it is a legal and binding contract with you and them, DO NOT take your deposite back!!!!! if you do your forfit any legal rights you have, call lawyer ASAP. they now HAVE to make it up to you since the car has 200 miles on it, the wheels are an easy fix.. miles no, call a lawyer and get it sorted out. do not let them screw you, they messed up and are trying to rip you off... make them pay! also call honda of america

but also.... id say run and cause trouble for them... honda of america... BBB... that kind of thing... run and make them hurt.... ALOT also try going to the media.... they can make their lives hell

False advertising consequences to a dealer

Contacting BBB and American Honda can lead to some serious consequences to a dealer. From ass loosing fines to license revocation and loss of being terminated by American Honda. Good to hear that is started up.
Now, let me explain you how much power you have with that big stick.
In mid nineties my best friend was in a market to buy VW GTI Golf. I found him Corrado G60 that he was only dreaming about at that point for $14K, yellow with Momo wheels and about 200 miles on odometer in Vasek Polak VW in Hermosa Beach, California.
We went there, just two of us with cash in hand and we were so young we were not even shaving yet! Dealer laughed at as when we came and asked for the keys of the car that we just walked by. They told us car is sold. I asked to see the proof. They told us to go pound sand. I asked if I could use the phone and with permission granted I dialed VW Corporate instead our mammy and daddy as they expected. They freaked! GSM was available all of a sudden. They brought the keys right away, but at that point I did not wont them anymore to my buddies surprise. Price kept falling on its own. We were at $12K in no time and I kept picking up the phone! I asked them if they ever had corporate mystery shoppers in their store. LOL! Finally the question I was waiting for: How can we make the whole thing go away including two of us? I pointed to a brand new loaded Corrado on the showroom floor next to us and told my buddy to count them $14K in cash. They started crying about tax, but I cut them off and calmly said: "$14K out the door, now otherwise it will cost you with some extra zeros by tomorrow." 15 minutes latter we were driving a brand new $19K listed, red Corrado home for $14K! They threw in those curbed Momo's in the deal, but we drove off on sweet BBS mash wheels and Dunlop tires that were a center piece in their part department! LOL!

Dude, GRAB THEM BY THE BALLS on Wednesday!

What's the story with the wheels? Why would a brand new sport car have the wrong wheels?

if i was in your place, i'd definitely call honda corporate and the BBB.

then i wouldn't take the car no matter WHAT deal they tried to offer me afterwards. screw them over back, i say.

it's your money, don't let them get away with anything. good luck to you

what they've told me about the wheels was the fit was a dealer swap. So they had no idea why the wheels weren't the sports wheels. and they would try to locate the wheels since this matter had brought to their attention. same story goes to the 200 miles.

I wouldn't believe the story about wheels or the mileage. I clearly told them that even the car was a dealer swap. They had to inspect every corner of the car. That was not my problem. I wanted a new 07 sport, so i expect an new 07 sport. Then they just start to "blah blah blah" didn't know this, didn't know that.

I also did brought up Honda America. I could't call them because the office is closed from 24th to 26th. The manager of the dealership seemed not to care much from his reaction.

It's 9am wed now. I am going to have to wait for their call. and Honda america is not open today either. Hopefull I can get what I want and just end this nosense before the year ends.

Also I had recorded the conversation between me and the manager of the dealership. Will that help at all?

Let me guess, if you just take delivery of the car now, they will do their best to get the wheels for you later? Right?

How's this? They take several hundred off the car's price and when they locate the wheels you'll come back and pay them the several hundred back to put them on the car.

I'd still walk away. It's not your fault if they got screwed by another dealer.

Run Run Run!!!! Why are you still dealing with this dealer? Did you sign anything? Did you pay them anything?

Don't call them. Don't show up. Run! Complain to Honda and find another dealer. That's not your car (problem).

Livd, DONOT take that car.

They will talk you into taking the car with the crap rims promising you they will locate sport ones, that's more crap.
This is to get you out the door so they have time to catch a case of permanent amnesia.

Get in touch with AH, they will care when AH calls them about your complaint and when they receive a letter from The AG!

It's a game of sales intimitation, don't get caught up in it.
They literally play on your emotions.

Get your $$$$$ and take a drive to Connecticut or Westchester, Ny, Fits all over the place.

**Call Greenwhich Honda in Ct 1st and speak to Evan.

That's a pretty common dealer practice... I'm sure the reason they couldn't switch them back was because they already sold them on ebay - that tacks $1500 onto the profit and SOME schmuck is gonna fall for it without knowing it's supposed to come with the wheels. Bam, $2500 profit (unless they did honda financing, then you're looking at $3-4000 profit.)

Woo, it's nice to be a Honda dealer.

Yea, go somewhere else... Remember, Carmax will ship any car they have to your nearest location, I'm sure they have some 200 mile fits too.

I hope you got out of it.

Just a word of advice, but did he know you recorded the conversation? If he knew about it, you're ok, but if he didn't, you could be in some trouble, depending on the laws of the particular state in which you live.

In any event, I hope you get justice.

it's pretty legal to record audio in a public place, though it's admissibility in a court of law could come into question if it wasn't agreed upon by both parties... Even that could challenged since they are allowed to record you without your consent (i'm sure the room you were in had a mic of some sort in it, seriously, thats why they "talk" to the manager so much if you're there with friend or relative)

[EDIT: I believe it's admissibility also has something to do with both parties having access to the recorded dialogue.]

Man something sounds crooked. I can understand your dealer is in a sticky situation, the dealer they swapped with must've done something crummy. My [random] guess is an employee was willing to sell a base fit to a friend but illegally swapped the sport wheels with the base one.

You've gotten good advice so far- but you can't use your recording in any legal sense unless the manager knew (because you told him) that his statements were being recorded. It doesn't sound like you will solve the problem with this dealer by the end of the year (tonight). but in spite of your frustration, you will still be much better off by waiting, and by buying from someone else. Getting your deposit, or down payment back, is easy. I did it myself from another crooked Honda dealer when I bought my Fit.

Happy New Year Guys.

Here is the update. It's been slow since the holiday.

I called HA and BBB on the 27th. I've got case number from HA but have not hear anything from BBB.

I was informed by HA that I should be expecting a call from them on the 01/02/08. Tomorrow. Hopefully there will be good news.

On the 27th, The dealer called me and told me that they wouldn't change the wheels for me. and I called them back telling them that I've already filed complain to HA and BBB. Haven't hear anything from the dealer since then.

during the wait. I went to another dealer, they also has a fit in their lot and it's also 07 and white. (thanks to skittles) This dealer wouldn't go down on the price. It's about 1000 dollar more than I agreed to pay for at the other dealer(the crooked one).

the only reason I am still waiting is that the 1000 dollar I was about to save from this crooked dealer. But I start to think if it's worth the headache.

and I've been thinking to just pull away and wait for the 09.

You know I've been reading this saga and thinking about the tremendous hit in depreciation everyone takes on a new car the moment they drive it off the lot. You're talking about buying a year-old car just for the color, and surely that means in spite of any price break you get from a dealer it's worth so much less the day after you buy it than a 2008 would be you lose out. If 2009's are going to come in white, waiting sounds like the smarter thing to do. I even wonder if buying an '08 and having it repainted white wouldn't be financially more beneficial.

And what about going and staring long and hard at some of the other colors to see if one of them might grow on you? I thought I wanted silver until I saw a Blackberry Pearl and it whispered my name.
