I think the one i got is defective, the gas gauge was reading fine at first and now it just keeps reporting it as a full tank, and it slowly started having this problem.

Whether the fuel pump is defective doesn't affect the fuel gauge, that's a separate part.

The fuel level sensor is a floater that attaches to the bucket you pulled out to do the fuel pump swap (not too different from an auto-stop floater in a toilet's water tank). It might be sticking or flat out failing. Try taking it out to see.

Fuel pump and float are part of the same assembly, but are separate. Ethanol is hell on everything it touches. You may have a sticking float, disconnected wire, or an ethanol gelling issue if the car sat for a bit.

isn't it the fuel pump itself that sends the signal? because to me the actual float looks like there is not really any electronics in it.

 

The fuel pump only pumps fuel.

The float doesn't have any complicated electronics. It's basically an rheostat where it's connected to the bucket.

From BMW_APLINA's link, scroll down a little bit to where you see the full bucket and you'll see a fan spread of metal where the float connects to the bucket. That's one electrical contact point, the other is on the arm itself. Where those two touch, is the fuel level.

 

As stated above, the pump and level sensor are part of the same assembly, but have different functions. It's likely that whoever installed your pump may have had an oops and disturbed the float.

Just wanted to follow up on how i resolved the issue. It really was the pump after all..... the DW pump kept reading full and it finally caught me with an empty tank. I ended up opening up the tank again and swaped back from stock BACK to the DW

I got so sick of it that I ended up just buying the Denso one, the GT-R fuel pump:

Well that person would be me. lol, but this new Denso fuel pump I have installed was done so perfectly. After doing this 4 times now... I feel like I am a professional at installing fuel pumps on our cars lol.
